Information Required for Compliance with the EU Digital Services Act (DSA)
Overview
The EU Digital Services Act (DSA) is designed to create a safer digital space, prioritizing transparency, accountability, and user protection. This includes User-Facing Disclosures such as ad labeling (like "Sponsored by" or "Paid for by" labels) so users can clearly see who funded or benefits from the ad, as well as Internal Platform Compliance, features for content moderation and regulatory reporting needs.
Certain platforms, including Kliken Ads and Facebook, require advertisers to submit specific information to meet these DSA regulations in advance of launching your ads.
Key Information We Need
To align with the DSA’s requirements, Kliken collects the following information from customers and partners. This data is essential for compliance and is provided to ad platforms to support your campaigns.
1. Beneficiary of the Ads
What It Means
Under the DSA, the beneficiary is the individual or organization ultimately benefiting from the ads displayed. Identifying the beneficiary is critical to ensuring transparency about the purpose behind the ads and the entity profiting from them.
Examples of Beneficiaries
Businesses Advertising Products or Services: The company or brand profiting from product sales or service engagement as a result of the ad.
Affiliate Partners or Sponsored Entities: If an ad promotes a third-party product or service, the beneficiary is the brand or individual associated with that product/service.
Individuals or Groups with an Initiative or Cause: For ads promoting causes, events, or social initiatives, the beneficiary would be the organization or individuals involved in those efforts.
Why This Information Is Required
By collecting beneficiary details, we ensure compliance with DSA guidelines, clarifying ad origins and protecting users from misleading or unclear advertising sources.
2. Payer of the Ads
What It Means
The payer is the individual or organization funding the advertising campaigns. Knowing who funds each ad enables transparency about the financial backing and intent behind advertisements on digital platforms.
Examples of Payers
Businesses or Agencies Funding Marketing Efforts: If a business funds its own ads or hires a marketing agency, that business (or the agency on its behalf) is considered the payer.
Affiliate or Sponsoring Organizations: In cases where ads are funded by third parties, like affiliates or sponsors, these entities are the payers.
Individuals or Groups Financing Personal Campaigns: For independent initiatives, the person or group financing the campaign is recognized as the payer.
Why This Information Is Required
The payer information helps users understand ad sponsorship, reducing the risk of misleading content and supporting Kliken’s commitment to DSA transparency requirements.
Why This Information Is Important
Providing this information ensures Kliken and its customers comply with DSA standards, allowing ad platforms to display your campaigns while promoting transparency and safety online. Here’s why this information matters:
Allow Ad Display: Without this information, we cannot review or forward your ads for platform approval, which means your ads will not be able to operate.
Promote Transparency: Clear insights into ad sources help maintain transparency and compliance.
Protect User Rights: Ensuring that ads are neither harmful nor misleading aligns with DSA safety standards.
Enable Responsiveness: Accurate contact details allow Kliken to respond quickly to compliance needs or changes.
How to Submit This Information
This information is normally provided at the time you build your campaigns. However, sometimes the platform captures the DSA requirement after you have completed your build, and completed your purchase.
In these instances, you will be notified via email and a banner in your dashboard. However, the below will support a manual update of your details.
